Public Procurement Act: EU-Kommission schlägt grundlegende Reform des Vergaberechts vor
Die Europäische Kommission hat am 9. September 2026 ihren Vorschlag für einen „Public Procurement Act“ veröffentlicht. Die drei bestehenden Vergaberichtlinien für klassische öffentliche Aufträge, Sektorenaufträge und Konzessionen sollen durch eine einheitliche, unmittelbar geltende EU-Verordnung ersetzt werden.
Auch Streitigkeiten über Aufkündigung oder Räumung eines Bestandobjekts werden nach § 7 Abs 1 IO durch die Insolvenzeröffnung unterbrochen, sofern nicht die Ausnahme des § 6 Abs 3 IO greift; die Unterbrechung ist von Amts wegen auch im Rechtsmittelverfahren zu beachten. Der OGH verdeutlichte nunmehr, dass die Auswirkungen der Insolvenzeröffnung unabhängig vom jeweiligen Verfahrensstadium zu beachten sind.
